I wasn't sure where to put this, so I started a thread.

This ruling will most likely alter everything we've come to know about pro and college sports.  As a guy working in HR at a private university, I see FLSA and PPACA impact, among other things.  So, what do you think?

Totally. I'm not sold completely on them being "employees" but I believe a lot of things need to change - monthly stipends, medical coverage for on-field injuries, a coach or someone helping a kid with a plane ticket home for the holiday, etc.  All those petty things that are considered violations.

What is their basis for determining this? They can't use the scholarship route because that is a grant - so that can't be considered a salary or taxable income.

Here's the decision:



from page 14:

"As the record demonstrates, players receiving scholarships to perform football-related
services for the Employer under a contract for hire in return for compensation are subject to the
Employer's control and are therefore employees within the meaning of the Act."

I think what always kept them considered "student-athletes" before was that participation on the teams was primarily considered part of the student's education.  Fast forward 30-40 years and the participation on the teams primarily benefits the schools in the form of big $$$.  So yeah, it was probably a matter of time...

True.  One possible consequence is that private universities who don't want to take on more "employees" could drop inter-collegiate sports.  Which would suck.

If schools did not drop sports, there could be a funky dynamic for recruiting talent.  Private schools would offer benefits, perhaps pay, while public schools could not...

Personally, I'm of the belief that they are employees and should be protected as such. And the free education angle? Assessing the intelligence highlighted during sideline reporting, I would say many of the athletes are there to play sports first and take basket weaving courses second. If there were a viable alternative (league) that did not have an educational requirement, they'd be playing in it.
