I wonder why they even bother with this stuff anymore.  I remember the whole knighthood tees thing back in the 90's, which I think they lost.
I doubt anyone is getting rich off the donut pattern.

It seems the donut horse is so far out of the barn that to try and go cracking down on it now because the band wants to "own" the pattern (read: make bucks off it) would come off as money-hungry and anti-fan.

They did lose the knighthood lawsuit... and they'll most likely continue to lose this donut thing... but they don't have an option but to continue to pursue every case. It's the consistency of policy and action around these trademark issues that allows them to maintain the trademarks they own... like the name Phish and the logo and the likeliness of Phish members, etc.

If they let anything that appears in any way to be a violation they must pursue lest they lose the right to pursue any case. To not pursue is to allow and opens the door to the Phish logo losing it's value to them.
