Title: Letter to Phish re: scalping
Post by: Play_It_Leo on March 18, 2009, 11:46:05 PM
I've had enough of trying to get seats for the Fox. I'm sure a lot of you have seen me in different forums complaining about the prices. I found 2 ebay listings that explicitly say they got their tickets from the lottery and are selling them for $1500 or so for a pair. I sent the following email to the band:

QuoteTo Whom It May Concern:

This letter is to inform you of blantant disregard for Phish's stated policy regarding their ticket lottery system. The policy states that:

Phish Tickets has a zero tolerance for scalping and insists that all patrons of our service abide by our policy stated herein. Tickets made available through this site are intended only for fans who are actually planning on attending the shows requested. It is strictly prohibited to resell any tickets obtained through Phish Tickets for more than the purchase price. If you are found to be reselling, trading or brokering tickets that you purchased through our site for profit, Phish Tickets may at its discretion cancel your ticket order and all other pending orders in your name.

I am a St. Louis resident and have been shut out of seats for my hometown show at the Fox Theatre. In desperation, I've been trying to find a "deal" on various broker sites. In searching ebay.com specifically, some persons lucky enough to have been granted tickets via the lottery are stating such and selling their tickets for $500-$1000/seat. Following are a few of the links to these persons who arein violation of the terms and spirit of the lottery agreement:

http://cgi.ebay.com/2-Phish-Tickets-06-16-09-FOX-THEATRE_W0QQitemZ230331904549QQcmdZViewItemQQptZUS_Tickets_all_in_one?hash=item230331904549&_trksid=p3286.c0.m14&_trkparms=72%3A1257|66%3A2|65%3A12|39%3A1|240%3A1318|301%3A1|293%3A1|294%3A50

http://cgi.ebay.com/2-Phish-Tickets-at-The-Fabulous-Fox-Theatre-6-16-09_W0QQitemZ300301500240QQcmdZViewItemQQptZUS_Tickets_all_in_one?hash=item300301500240&_trksid=p3286.c0.m14&_trkparms=72%3A1257|66%3A2|65%3A12|39%3A1|240%3A1318|301%3A0|293%3A1|294%3A50

Many of the other tickets listed on ebay for similar prices also appear to be in the same section(s), implying to me that they also may be tickets from the lottery. As a fan, I would like to think I would do anything to see a Phish show in my home town. As a father of 2 small children, I can't possibly justify paying anywhere near this much.

I am uncertain what steps you may be able to take to prevent the above tickets from being sold for exorbitant amounts. If you are able to intervene, thank you very much on behalf of all true Phish fans. We care too much for the band, music, and the fan community to stand for selfishness such as this. If you aren't able to put a stop to this, I appreciate all your efforts to end this abuse.

Sincerely,

Chris Dollenmeyer
St. Louis, Missouri

If any of you guys see similar auctions/"sales" that state that they have lottery seats, please report them and see if we can get a few more seats back into our hands instead of brokers.

I've said it before and I'll say it again, I NEVER got shut out for any show with the old system, not NYE shows, not Halloween shows, nothing.  I for one would love it if they went back to the old system.  But, the brokers would just hire people to fill out the forms and get the tickets mailed to them, so I don't really think it would solve anything, I just liked doing it more.

QFT, and I don't really think that there is any end all be all system to stop scalpers and brokers from getting their hands on the tickets.  I fact, I think that on the whole, Phish fans have been lucky that no one has really paid that much attention to us and we have never really had to deal with this on this scale until now, where as this same thing has been plaguing the more well known "big" acts for decades.  Our scene has finally grown up.

A much better course of action would be to find eBay regulations that these auctions violate and report them to eBay.

Phish has no legal recourse over these auctions.

While I agree with you about the course of action, Phish does have legal recourse over the individuals that put these tickets up for auction through the agreement included in ticket purchase.  Admitting that the tickets came from lottery also implicates these individuals.  Reporting the activities to Phish couldn't hurt, and just might help.

So you think they should try and figure out who this person is (based on their eBay ID?), then cancel or void their tickets?

How do you propose they do that?

Let's just get real about things for a second.

Nice find nab. I figured there was a way, just depends on ebay's cooperation. I do not feel this is a waste of time. If any band would take the time to get their tickets back from a blatant scalper of tickets like this, it's  :phish:

Then people will just take their tickets to Stubhub.

The best way to get tickets out of the hands of scalpers is for "fans" not to buy them on the secondary market.

How many people on this board bought Hampton tickets on eBay or StubHub?

Truth.  Although I think it's OK to buy them on the secondary market myself.  What's not OK is paying hundreds of dollars over face.  If these douchebags can only make a couple bucks on Phish tickets then they'll stop bothering with them.

I'm not disagreeing that scalping will continue to be a huge problem. I agree that the best way to cut down on it is for less people to buy outrageously priced tickets. But when someone is blatantly flaunting that they got their tickets from the lottery, I'd like for the band to put them in their place just once and revoke their tickets before they're mailed.  And yes, next time they do it they'll be smarter about it. I'll take small victories for us vs. the brokers though.

That's awesome matt. I'm hoping to get day-of-show tickets for the Fox the way things are going. Hopefully people stay away from stubhub/ebay and there's still a lot of tickets unpurchased when the show rolls around. Odds on that w/ the 2009 version of Phish is a lot less likely though. It's the unfortunate reality of v3.0.

Actually there is a method to stop scalping that has been discussed here before: ticketless tickets.  2 ticket max per order, bring ID and credit card to show to gain entrance.  Your guest must be present with you upon entry.  NIN employs a similar scheme with their lottery tickets.

Tom Waits did this with his entire tour last summer, all sold through TM.  Of course this also makes tickets untradeable or unsellable at face, but this also prevents folks from putting in for tickets to shows they'll never goto in hopes for a trade.

I am not sure what the barriers are for Phish to do this.

Add to this equation the fact that Phish fans are by and large more established in their lives now, better off, more able to afford the exorbitant prices

Phish shows are fun, but they have never been worth a months rent to me.

The shows that are easy to get tickets too are often the most fun.

This time next year the buzz will have died down and Summer 2010 tour will be mostly easy to get into.

Honestly?  I don't think it's any harder then scanning a ticket. At Waits they had handheld devices: they checked my ID, swiped my AMEX, a seat assignment printed out, and we walked right in.  No hassles.

I don't know what the heck was up at Hampton.  It was the lamest security patdown ever.  No idea what the logic was there.

Since the tickets have not been mailed yet, Phish should tell those bastards they violated the terms of the sale, cancel their tickets and then refund their money.  Then, draw another name from the Fox requests (surely they still have that data somewhere), send that person an email offering the tickets to them...if they decline, go the next name on the list, etc.

That would seem like a reasonable way of dealing with this, especially since they admitted they won the tickets on through the lotto.

Sunday Hampton was my first scalper ticket.  Im not ruling it out for Red Rocks.

t34m.ca has remained remarkably dedicated, and tight-knit, mattstick.  Its really impressive.  But my bottom line is that I just dont have the resources for tickets I once had.  Of the 5-6 regular people I saw shows w/ 96-00, all but one are pretty much out of the loop completely.  You know how 5-6 people can turn into 30 when youre looking for tickets - everyone has leads on tickets outside your crew, someone always comes through for someone else in the end, usually from individual outside connections.  It just doesnt work out for me that way anymore.

It's easy for me to say that I won't buy scalpers/brokers/eBay tickets but when Phish plays Massey Hall in Toronto and I'm shut out that'll be the true test.

Only time I was shut out of mail order was Halloween '96, and we had a Hurricane that weekend in at my school that shut down the mail for at least half a week, so none of us got our mail order.

that was a totally different scenario though, and it was still mega easy to score tix. compared to Phish 09...wellshit, you cant compare. the reason the demand for dead tickets rose so dreastically was almost soley a result of their comeback in the popular music market___the "touch-head" phenomenon. after being played on MTV and scoring their first #1...ever(?) they were basically 'outed' from their cult following of the 80s. the mess we have with Phish3.0 and tickets has a bunch of different factors that really make it impossible to compare to the situation of the dead's relative popularity in the 90s.

There are numerous places for me to purchase tix in Vegas. And I have family that is willing to help me by going to each outlet and snagging as many tix as they can get if I need them too.

Vegas will NOT be a problem.

When Phish comes to Vegas I'll be buying tix for anyone who's worried about getting shut out.  :-D

Just sayin'...

Remember, I tried to buy Asheville tickets at the outlet...

There are numerous places for me to purchase tix in Vegas. And I have family that is willing to help me by going to each outlet and snagging as many tix as they can get if I need them too.

Vegas will NOT be a problem.

I was also third in line :)

I strongly believe that Obama should now pass legislation putting a 10% cap on the profit margin on any and all tickets for resale... Cap the Basterd CEO's and the Ticket Basterds ruining and invading our Good Vibes!!!

Yeah, it's only funny if you pretend to be crippled but really aren't, so that you can enter into the Special Olympics and beat all the cripples, and win, like a thousand dollars or something!

South Park (http://www.southparkstudios.com/guide/803/) also has an episode about that.

Yeah, the movie TOTALLY stole the idea from South Park...that episode aired at least a year before that movie came out, IIRC!

It was still pretty entertaining, though!  :-P

Are you speaking of the stimulus bill... or the law that already exists against scalping..?

Just not sure if your missing my sense of humor or not... i.e. - like the little added sentance or provision about the AIG execs. being allowed to collect their bonuses... Just was playing on the pun...
